Our Approach

We try cases.

Unlike many lawyers at large firms, we’re not afraid to go to trial. We don’t try every case. Many disputes can and should settle, and some clients are better served when we devote most of our energies to negotiating reasonable and imaginative settlements that keep their disputes out of the courtroom. But we have learned over decades of practice that clients achieve the best results only if their lawyers and adversaries believe that their cases may be tried to verdict. That is why, from day one, we handle every case with a strategy for winning at trial.



We work collaboratively with our clients to achieve their goals.

We collaborate closely with our clients to try to meet their financial and other goals. When we interview witnesses, review documents, or engage experts, we decide what to do and what not to do based on a reasoned assessment of how our work will help our clients get what they want. When we advise our clients on settlement, we evaluate the amounts currently offered or demanded, the practical and legal risks and costs associated with further litigation. For us, pre-trial discovery, motions practice, and even trials are means to an end. They are never ends in themselves.



We offer alternative fee arrangements.

We provide flexible fee arrangements to suit the preferences of each of our clients. We will work for hourly fees if a client prefers such an arrangement, but we often link at least a portion of our compensation to the outcomes of our matters.  In addition to hourly arrangements, we often handle cases for pure contingent fees, flat fees, and hybrid compensation structures that result in our sharing some of the client’s litigation risk while earning a reduced fee. By offering alternative fee arrangements, we try to best align our interests with our clients’ interests.

When fighting for our clients in court or negotiating for them at the bargaining table, we take a smart, aggressive approach that considers our clients’ business needs, the practicalities of their legal problems, and the possibility that decisions made today will affect what happens at the conclusion of the case.
