Derek Sugimura’s practice focuses on interbank disputes, using negotiation, alternative dispute resolution, and-when necessary-litigation to maximize recoveries in a fast and efficient manner for his clients. Mr. Sugimura also has significant experience in policyholder-side insurance coverage litigation and public interest work.

Recent matters include:

  • Representing a trustee in bankruptcy in the appeal of a fraudulent conveyance judgment
  • Defending a loan officer accused of complicity in a mortgage fraud by a title insurer
  • Representing a Fortune 100 national bank in pursuing mortgage fraud claims, title insurance claims, and bankruptcy recoveries
  • Securing an $11 million judgment on a mortgage fraud claim
  • Negotiating settlements of tens of millions of dollars in disputes between banks regarding residential mortgage loans sold on the secondary market
  • Advising on business risks in the residential mortgage industry
  • Participating in the settlement and global resolution of a title company’s $34 million fraud scheme
  • Representing corporations and bankruptcy trusts in seeking insurance coverage, including
    • a major auto parts manufacturer seeking coverage for bodily injury and environmental liabilities;
    • several manufacturers or installers of asbestos-containing insulation in seeking coverage for bodily injury liabilities;
    • a claimants’ committee in a major hospital bankruptcy seeking directors & officers coverage; and
    • an automotive sales company seeking errors & omissions coverage
  • Representing a public interest group seeking remedies for violations of the Fair Housing Act and Americans with Disabilities Act against seven different real estate developers
  • Participating in the drafting of amicus briefs for public interests organizations seeking to influence Supreme Court decisions on school integration and Don’t Ask Don’t Tell

Before entering private practice, Mr. Sugimura served as a law clerk to the Honorable Howell Cobb, U.S. Senior District Judge for the U.S. Eastern District of Texas in Beaumont, and to the Honorable Marcia Crone, U.S. District Judge for the Eastern District of Texas. Mr. Sugimura previously was an associate at a litigation boutique based in Washington D.C.
