Lee Marc Epstein is a civil litigator and trial lawyer. For nearly thirty years, he has focused his practice on securing insurance recoveries for corporate and individual policyholders in response to all forms of liabilities as well as first-party and business interruption losses arising from catastrophic events and commercial crimes. In that capacity, he has represented market leaders in the satellite television, airline, chemical, financial, mining, food and HVAC&R industries. He is currently litigating insurance coverage disputes throughout the state and federal courts of the United States.

Representative First-Party Property & Business Interruption Insurance Matters:

  • Represented multi-national conglomerate in all business interruption matters arising out of the 9/11 attacks
  • Represented five-star Miami Beach Hotel after delayed opening following water and mold damage
  • Assisted large HVAC&R manufacture in settlement of a business interruption claim after an explosion caused a cessation of all operations
  • Successfully argued federal court appeal on behalf of a for-profit educational company that was shut down after the 9/11 attacks
  •  Successfully settled business interruption claim on behalf of a Mexican subsidiary of U.S. based multi-national corporation after third-party pollution caused plant shut down
  • Represented multi-national trade association that suffered an interruption of operations after a water loss
  • Successfully arbitrated a business interruption claim on behalf of a cogeneration facility
  • Served as an appraiser on behalf of a water utility that was shut down after Hurricane Floyd
  • Settled a first-party property insurance coverage case involving computer hacking on behalf of a telecommunications company after defending insurer’s motion to dismiss

Representative Third-Party Liability Insurance Matters:

  • Secured appellate affirmance of a trial court’s ruling that an insurer is obligated to defend underlying asbestos cases entirely rather paying only for a pro rata portion of defense costs
  • Successfully argued the appeal on behalf of a satellite television provider in a patent infringement insurance coverage case
  • Successfully tried and then secured appellate victory in a hearing loss insurance coverage case on behalf of a multi-national sugar refiner
  • Secured a jury verdict on behalf of condominium association in response to insurer’s denial of coverage for a multi-million dollar personal injury claim
  • Successfully tried an environmental insurance coverage case on behalf of a major financial institution
  • Secured an insurer-provided defense for a satellite television provider in connection with an underlying lawsuit commenced by the United States 2 and four state governments under the Telephone Consumer Protection Act and other statutes governing unsolicited communications
  • Secured insurance coverage settlements totaling several hundred million dollars in connection with underlying asbestos and other products liability claims on behalf of a major chemical company
  • Secured a defense and indemnification for a major HVAC&R manufacturer under insurance policies issued to a corporate predecessor
  • Representing a boiler manufacturer in insurance coverage case for underlying asbestos liabilities
